1.1. Whistler AI ("we", "us") is operated by Kristina Yadova, a self-employed individual entrepreneur. By using whistlerai.online or the Whistler AI Telegram bot (together, the "Service"), you agree to these Terms.
1.2. If you do not agree to these Terms, do not use the Service.
2.1. Whistler AI converts audio and video (that you upload or link to) into text transcripts and structured summaries, using automated speech recognition and AI language models. Optional add-ons include speaker/timestamp separation, emotion recognition, personal-data tagging or redaction, and voice deepfake detection.
2.2. A limited free quota is available on sign-up. Paid plans (Lite, Max) unlock larger monthly hour quotas and additional sources/features, billed via Telegram Stars inside the Telegram bot.
2.3. We may change, add to, or discontinue features of the Service at any time. We'll try to give reasonable notice of changes that materially reduce what a paid plan includes.
3.1. You must be at least 16 years old to use the Service. You access it through your Telegram account; you're responsible for keeping that account secure.

4.2. You are solely responsible for the content you submit and for having any consents needed from third parties whose voices or likenesses appear in it.
5.1. Paid plans are billed in advance for the period you choose (monthly, 6-monthly, or yearly) via Telegram Stars.
5.2. Subscriptions renew automatically at the end of each period unless you turn off auto-renewal beforehand. You can do this at any time in /mysubscription in the bot; turning it off stops future charges but does not shorten the period you've already paid for.
5.3. Refunds are handled under our separate Refund Policy.
6.1. You retain all rights to the content you submit and to the transcripts/summaries generated from it. We claim no ownership over your content or its output.
6.2. The Service itself — its software, branding, and design — belongs to us or our licensors. These Terms don't grant you any rights to it beyond using the Service as intended.
7.1. Automated speech recognition and AI summarization are not perfect. We do not guarantee that transcripts, summaries, emotion labels, personal-data detection, or deepfake-detection results are complete, accurate, or fit for any particular purpose — including legal, medical, or safety-critical use. Always verify anything important against the source recording.
7.2. The Service is provided "as is". We don't guarantee it will be uninterrupted, error-free, or available at all times.
8.1. To the maximum extent permitted by law, our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 3 months before the claim arose. We are not liable for indirect, incidental, or consequential damages.
8.2. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death, personal injury caused by negligence, or fraud.
9.1. You may stop using the Service at any time. We may suspend or terminate access for violation of Section 4 (Acceptable Use), with notice where reasonably possible.
10.1. These Terms are governed by the laws of the Russian Federation, without prejudice to any mandatory consumer-protection rights you have under the law of your country of residence, which continue to apply where applicable.

11.1. We may update these Terms from time to time. Continued use of the Service after a change takes effect means you accept the updated Terms.
